While social networking sites provide an array of opportunities for attorneys to market their services, connect with other lawyers and potential clients, a reality check dictates that they also have the potential to pose significant risks especially with respect to ethics. Consequently, attorneys must use social media with caution and must be up-to-date with respect to the important issues surrounding social networking and its impact on the legal profession. In addition, litigators must be in the know regarding the latest rules governing the preservation and use of social media data.

David Lewis’s practice is focused on legal ethics and professional conduct, including issues surrounding conflicts of interest, legal advertising regulations, cross-border legal practice issues, litigation conduct, attorney-client privilege and client confidentiality, bar admission requirements, fee disputes, law firm structure and risk management. He has represented clients in a variety of professional matters, including defending lawyers against charges before disciplinary committees, legal malpractice cases and representing lawyers and law firms in cases involving disqualification. Mr. Lewis is the appointed Chair of the New York City Bar Association’s Professional Responsibility Committee (2011-2014), and he is also the Vice-Chair of the New York State Bar Association’s Task Force on Nonlawyer Ownership. Eulonda Skyles is an experienced litigator who specializes in litigating intellectual property, technology and business disputes on behalf of high-technology and Internet companies. She has significant experience with Internet law and intellectual property disputes arising under the Communications Decency Act and the Digital Millennium Copyright Act. Her litigation experience also includes representing technology companies in patent suits, securities derivative suits, consumer class actions involving false advertising and unfair competition claims, and privacy and security breaches.
Prior to joining Orrick, Ms. Skyles served as head of litigation and risk management/compliance at SafeNet, Inc., a data security and encryption technology company based in Maryland. She also served as litigation counsel for Yahoo! Inc., where she oversaw domestic and international litigation and provided legal counsel to business clients in the areas of product compliance, online privacy regulations, data security and legal risk analysis involving indemnities, warranties, joint-ventures, and mergers and acquisitions.
