In a recent putative class action complaint filed in the Federal Court in Washington D.C., a borrower accused the Federal National Mortgage Association (“Fannie Mae”) of unauthorized inquiries into the borrowers' credit information after the borrowers' debts have been discharged in bankruptcy. The recent allegations are iteration of recent lawsuits under the Fair Credit Reporting Act (FCRA) that challenges post-bankruptcy discharge activities on consumer debts and may potentially give rise to a new wave of similar lawsuits in the coming years.
