The Future of Antitrust and Competition Law Under President Trump
The election of Donald Trump could cause sweeping changes in antitrust law and enforcement policy. Mr. Trump has promised to oppose the pending AT&T – Time Warner deal, and has suggested that his administration will enforce antitrust law against news media companies with “too much power” – including some that have been critical of him. He has advocated new statutes to permit antitrust suits against foreign governments. His promise to repeal the Affordable Care Act could affect antitrust enforcement involving a wide range of health care transactions. And his nomination of Supreme Court justices and other federal judges could have far-reaching effects on the substantive and procedural rules governing antitrust litigation.
