Overview:
The Knowledge Group is producing a live webcast: IP Update: Trademark Registration Benefits to help firms and corporations better understand the Benefits of Trademark Registration.
Unregistered trademarks receive some protection under the common law and under the Lanham Act. However, registration of trademarks provides additional benefits and, substantive and procedural rights. Registration grants the right to use the registered trademark symbol, to file trademark infringement lawsuits, and restricts registration of similar trademarks.

The discussion will focus generally on the reasons to register trademarks rather than relying on common law use.
Registration benefits can be roughly broken down into 3 categories:
- Deterrence
- Evidentiary benefits in court proceedings • The establishment of priority and territory
Specifics will include the use of the PTO as a first line of defense, through the USPTO’s searchable database and actions by the Examining Corps; the efficiency of having prima facie evidence of exclusivity and ownership in an infringement action, and how the territory and acquisition of priority can be established by a registration.
