HIPAA Regulations and Patient Privacy Rights in 2016
The HIPAA Privacy Rule deals with Protected Health Information (PHI) in general, while the HIPAA Security Rule (SR) deals with electronic Protected Health Information (ePHI) – which is a subset of that encompassed under the HIPAA Privacy Rule. The HIPAA Security Rule requires implementation of administrative, physical, and technical safeguards and documentation requirements.
The Department of Health and Human Services Office for Civil Rights (OCR) recently reported that it will begin auditing regulated entities for compliance with the HIPAA Privacy and Security Rules. Regulated entities must report to OCR annually regarding breaches of unsecured 'protected health information' affecting fewer than 500 individuals.
Hence, companies handling personal health data need to be aware of the need to determine their risks, protect and upgrade their networks, enhance security policies and procedures, and monitor and control data sharing to avoid costly corrective actions or fines. But the consequences may be limited since signing a federal Health Insurance Portability and Accountability Act (HIPAA) agreement does not ensure the privacy of an insured individual. Rather, it merely notifies an insurer that the information may be shared with any concerned parties whenever deemed necessary. In light of data breaches, such as that recently suffered by CareFirst, this kind of lax legislation seems perverse. But, personal data is a valuable commodity and large corporations have significant powers.
