The excise tax to be imposed on medical devices under the Affordable Care Act took effect in January 2013. Though the conflicting bill Health Care Cost Reduction of 2012 has surfaced and would actually repeal the excise tax on medical devices, there’s a little chance that the rule on medical device excise tax will be repealed. It is therefore essential that medical device manufacturers must have a complete understanding on how to navigate through the complex tax issues that the medical excise tax could offer to their businesses and to avoid potential tax penalties.
