The Defend Trade Secrets Act (DTSA) of 2016: Impacts and Implications to Trade Secrets Owners Uncovered!
A few months ago, President Obama signed the Defense Trade Secrets Act (DTSA) of 2016 into law. The Act will create a federal private civil action for the misappropriation of trade secrets and provide trade secret owners the ability to request for an ex parte seizure under certain extraordinary circumstances. All misappropriations occurring after the bill's enactment are covered and affected by DTSA. Despite its speedy passage and abrupt changes, the Act will provide protection to whistleblowers from retaliatory accusations of trade secret misappropriation.
