I will cover recent trends in class action litigation in the health care industry. Several factors conspire to make a significant increase in class action activity in this space probable. In fact, it is already increasing. First, the size of the health care industry is so vast – 17 per cent of GDP – that it includes a huge number of the consumer transactions in our economy. Second, the nature of the industry is such that there is a great deal of uniform conduct covering large numbers of potential plaintiffs. For example, privacy, collection, insurance and doctor’s rights are all areas where class action activity is beginning to surge. Third, other areas where there have traditionally been large numbers of class actions have become less hospitable to class action filings due to recent US Supreme Court decisions. As a result of all of this we can observe the health care industry experience as it evolves, both to understand that industry and to understand how it may inform other industries both in terms of class action trends and preventative measures that may be taken to decrease defendants’ potential exposure to class action liability.
